Decisions adopted by the Board of the Financial Supervisory Authority

Bucharest, 28 November 2023 – At today's meeting, the Council of the Financial Supervisory Authority (ASF) adopted measures on the functioning of the supervised non-bank financial markets - insurance, capital market and private pensions, as follows:

A) Regulation

Draft Regulation on the authorisation of entities referred to in Art. 163² of the Government Emergency Ordinance no. 99/2006 on credit institutions and capital adequacy (the draft will be published on www.asfromania.ro for public consultation for 10 days);

Rule on compulsory insurance of dwellings against earthquakes, landslides and floods (the rule will be sent for publication to the Official Gazette of Romania);

Rule amending and supplementing the Financial Supervisory Authority’s Rule No. 3/2014 on internal control, internal audit and risk management in the private pension system (the rule will be sent for publication to the Official Gazette of Romania);

Draft Regulation amending and supplementing the Regulation of the Financial Supervisory Authority No. 15/2021 on the use of the system of omnibus accounts and the application of mechanisms without pre-emption of financial instruments and the Regulation of the Financial Supervisory Authority No. 16/2021 on the establishment, disclosure and enforcement of security interests (the draft will be published on www.asfromania.ro for public consultation for 10 days);

Rule amending and supplementing Rule No. 3/2013 on the marketing activity of the privately managed pension fund, approved by the Decision of the Private Pension Supervisory Commission No. 5/2013 (the rule will be sent for publication to the Official Gazette of Romania);

Rule amending and supplementing the Financial Supervisory Authority's Rule No. 16/2013 on the marketing activity of the voluntary pension fund (the rule will be sent for publication to the Official Gazette of Romania);

Rule amending and supplementing the Financial Supervisory Authority’s Rule No. 10/2014 on the activity of deposit and custody of assets of voluntary pension funds (the rule will be sent for publication to the Official Gazette of Romania);

Rule amending and supplementing the Financial Supervisory Authority’s Rule No. 11/2014 on the activity of deposit and custody of assets of privately managed pension funds (the rule will be sent for publication to the Official Gazette of Romania).

B) Authorisation

Approval of Mr. Cosmin-Petru Tudor as Deputy General Manager of the company Pool-ul de Asigurare Împotriva Dezastrelor Naturale S.A. (PAID);

Approval of Mrs. Andreea Voinea as member of the Supervisory Board of Omniasig Vienna Insurance Group S.A.;

Approval of Mr. Vadim Vodovoi as member of the Board of Directors of Asito Kapital S.A.;

Approval of Mr. Dascăl Sergiu - Dan as member of the Board of Directors of the Association of Fund Administrators;

Approval of the application for authorisation of Ms. Rodica Jugănaru as the person in charge of the internal control structure of NN Pensii Societate de Administrare a unui Fond de Pensii Administrat Privat S.A.;

Approval of Mrs. Liane Maria Hirner as member of the Supervisory Board of the company Asigurarea Românească - Asirom Vienna Insurance Group S.A.;

Approval of Mrs. Liane Maria Hirner as member of the Supervisory Board of BCR Asigurări de Viață Vienna Insurance Group S.A.;

Approval of Mrs. Liane Maria Hirner as member of the Supervisory Board of Omniasig Vienna Insurance Group S.A.;

Approval of Mrs. Anita-Laura Nițulescu for a new mandate as member of the Board of Directors of Eurolife FFH Asigurări Generale S.A.;

Approval of Mrs. Anita-Laura Nițulescu for a new mandate as member of the Board of Directors of Eurolife FFH Asigurări de Viață S.A.;

Approval of the application for authorisation of Mr. Pavol Dorčák as a member of the Board of Directors of Metropolitan Life Societate de Administrare a unui Fond de Pensii Administrat Privat S.A.;

Approval of Energeia Capital S.A.’s application for authorization of the privately held alternative investment fund Encap Global Alpha and its registration in the public register of ASF as such;

Approval of the application of S.A.I. Certinvest S.A. for the authorisation of the amendments to the Rules of the alternative investment fund Certinvest Green;

Approval of the application of the financial investment services company Investimental S.A. to authorize the change in the organization and functioning of the company as a result of the share capital increase;

Approval of the application for authorisation to amend the Articles of Incorporation of Aegon Pensii - Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for final approval of the amendment to the Prospectus of the voluntary pension scheme for the Voluntary Pension Fund Stabil managed by Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for prior approval of the amendment to the Prospectus of the voluntary pension scheme for the Voluntary Pension Fund Pensia Mea, managed by BT Pensii - Societate de Administrare a Fondurilor de Pensii Facultative S.A.;

Approval of the application for final approval of the amendment to the Prospectus of the voluntary pension scheme for the Voluntary Pension Fund AZT Moderato, managed by Allianz-Țiriac Pensii Private Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for final approval of the amendment to the Prospectus of the voluntary pension scheme for the Voluntary Pension Fund AZT Vivace, managed by Allianz-Țiriac Pensii Private Societate de Administrare a Fondurilor de Pensii Private S.A.
