Notice on the publication on the ESMA website of several guidelines on rating agencies

1. Guide on internal controls for credit rating agencies (ESMA 33-9-371)

The guide mainly states that:

applies to credit rating agencies established in the EU and registered with ESMA in accordance with Regulation (EC) No 882/2004. Regulation (EC) No 1060/2009 of the European Parliament and of the Council of 16 September 2009 on credit rating agencies;
concerns matters relating to the structure and internal control mechanisms necessary to ensure the effective compliance of the credit rating agency with Article 6 (1), (2) and (4) of Regulation (EC) No 882/2004; 1060/2009 and Section A of Annex I thereto;
shall apply from 1 July 2021.

2. Guidance on presentation requirements for credit ratings (ESMA 33-9-320) 

The guide mainly states that:

applies to credit rating agencies established in the EU and registered with ESMA, in accordance with Regulation (EC) No 882/2004. Regulation (EC) No 1060/2009 of the European Parliament and of the Council of 16 September 2009 on credit rating agencies;
concerns in particular matters relating to the publication of credit ratings, rating outlooks and methodologies and models of credit rating agencies registered in the EU in accordance with Article 10 (1), (2) and (5) and Annex I, Section D, Part I, points 1, 2, 4 and 5 and Part III, points 1, 2, 2 (a) and 4;
ESMA will consider this guidance for monitoring purposes from 30 March 2020.

  1. Guide on the submission of regular information to ESMA by credit rating agencies - 2nd edition (ESMA 33-9-295)

The guide mainly states that:

applies to credit rating agencies registered in the EU;
does not apply to certified credit rating agencies;
enters into force two months after its publication (07.04.2021) on the ESMA website in all official EU languages.

The guide also sets out the information to be provided by credit rating agencies in order to enable their permanent and consistent oversight by ESMA. It also clarifies ESMA's expectations regarding the information to be provided to it in order to calculate the supervision fees and market shares of credit rating agencies.
