Bucharest, 15 February 2023 – During today's meeting, the Council of the Financial Supervisory Authority (ASF) adopted measures on the functioning of the supervised non-bank financial markets - insurance, capital market and private pensions, as follows:
A) Regulation
Regulation amending and supplementing ASF Regulation no. 3/2013 on the authorisation and operation of central counterparties issued in accordance with the provisions of Regulation (EU) no. 648/2012 of the European Parliament and of the Council of 4 July 2012 on OTC derivatives, central counterparties and trade repositories (the Regulation will be sent for publication to the Official Journal of Romania);
Rule amending Rule no. 7/2007 on the prospectus of the private pension scheme, approved by the Decision of the Private Pension Supervisory Commission no. 26/2007 (the rule will be sent for publication to the Official Journal of Romania);
Rule amending Rule no. 16/2010 on the voluntary pension scheme prospectus, approved by the Decision of the Private Pension Supervisory Commission no. 27/2010 (the rule will be forwarded for publication to the Official Journal of Romania).
B) Authorisation
Approval of the application of S.A.I. Broker S.A. for authorisation of changes to the rules of the Private Equity Alternative Investment Fund H.Y.B. Invest;
Approval of the application of S.A.I. Atlas Asset Management S.A. for authorisation of the Alternative Investment Fund with private capital Agricultural Fund and its registration in the public register of ASF as such;
Approval of the issuance of the Certificate of Registration of the share capital increase of Sinterom S.A. Cluj Napoca and the adoption of the insurance measure of one-time blocking of the transfer of the shares with which the share capital was increased, starting from the date of their registration with Depozitarul Central;
Approval of amendments to the Articles of Incorporation of Klausenburg Broker de Asigurare S.R.L. (transfer of shares, new significant shareholder, shareholder structure, appointment of administrator, amendment of articles);
Approval of the request for final approval of the amendment to the prospectus of the voluntary pension scheme for the Voluntary Pension Fund Pensia Mea, managed by BT Pensii - Societate de Administrare a Fondurilor de Pensii Facultative S.A.
